Challenging an account of an ongoing Ladder Tournament will force the battle to be public even though it is not a ladder battle.

I noticed it when I was battling my friend (in another tier) having the alt account of the ongoing Almost Any Ability ladder tournament. We did battle multiple times and it was not possible for me to make those rooms hidden using a command or from the " Don't allow spectators " option when challenging.
I also noticed the battles won't expire. edit: They did.
